DALECKI STRENGTH (trading as “Dalecki Strength”) of 1/32 Lilian Fowler Place Marrickville is a comprehensive gymnastics coaching company which includes a variety of athletic training services including online coaching programs (the “Services”).


By signing the below, I acknowledge, understand and am aware that:


  1. I have voluntarily chosen to participate in the Services provided by Dalecki Strength.
  2. I understand there are inherent risks in all aspects of physical training and the potential for undesirable physiological results including, but not limited to abnormal blood pressure, muscle soreness, fainting, heart attack, bodily injury and/or death.
  3. I also acknowledge that I have been specifically warned about the medical condition “Rhabdomyolysis” and accordingly I have been advised to limit my effort in order to minimise the risks associated with this condition.
  4. I understand that the training may involve gymnastic movements, strenuous bodyweight exercises and other high exertion activities, and I am physically able to to participate in the Services safely.
  5. I am not obligated to perform nor participate in any activity that I do not wish to do. I am free to withdraw from, reduce or modify my involvement in any of the Services at any time, and realise I should do so if I experience any physical discomfort.
  6. I understand that should I feel lightheaded, faint, dizzy, nauseated, or experience pain or discomfort, I am to stop the activity.
  7. Any Services that recommend changes to my diet including the use of food supplements, weight reduction and/ or bodybuilding techniques are entirely my responsibility and I should consult with a doctor before undergoing any dietary or physical activity changes.
  8. The Services provided to me by Dalecki Strength are personal to me and I understand that the program, coaching techniques and videos of drills and techniques are proprietary and I understand that I may not appropriate any material from the Services.
  9. Permission is granted to temporarily download one copy of any downloadable materials on the Teachable Dalecki Strength platform for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not: modify or copy the materials use the materials for any commercial purpose, or for any public display (commercial or non-commercial) and under this license you may not:
    1. attempt to decompile or reverse engineer any software contained on the School’s web site;
    2. remove any copyright or other proprietary notations from the materials; or
    3. transfer the materials to another person or 'mirror' the materials on any other server.
  11. I agree to allow Dalecki Strength, its agents, officers, principals, employees and volunteers to use picture(s), film and/or likeness of me for advertising purposes.
  12. To the maximum extent permitted to me by law, I unconditionally RELEASE THE RELEASEES from any and all liability for any loss, damage, injury or expense that I may suffer, or that my next of kin may suffer as a result of my participation in the Services provided by Dalecki Strength due to any cause whatsoever including negligence, breach of contract, or breach of any statutory or other duty of care.
  13. I agree to WAIVE ANY AND ALL CLAIMS that I have or may have in the future against Dalecki Strength, and its directors, officers, employees, agents, volunteers, sponsors and independent contractors (all of whom are hereinafter collectively referred to as “the Releasees”).
  14. I agree to HOLD HARMLESS AND INDEMNIFY THE RELEASEES from any and all liability for any damage to the property of, or personal injury to, any third party, resulting from my participation in the Services provided by the Releasees.
  15. This agreement shall be binding upon successors, my representatives, heirs, executors, assigns, transferees and me.
  16. This agreement shall be governed by the laws of New South Wales.
  17. If any portion of this agreement is held invalid, I agree that the remainder of the agreement shall remain in full legal force and effect.
  18. By signing this waiver I am waiving certain legal rights, including the right to sue, against the Releasees.
